This indenture made this 15th day of May in the year of our Lord 1820 between Clayborn Spain of the County of Guilford and state of North Carolina of the first part John M. Dick of the county and state aforesaid of the second part and Henry Humphreys and Abraham of the county and State aforesaid of the third pat witnesseth whereas the said Clayborn Spaign on the 14th day of May 1820 executed a bond for the sum of two hundred and sixty two dollars and a half cents payable to the said Henry Humphreys and Abraham Geren which wass all merchants in trade under the name and firm of Humphreys and Geren and whereas the said Clayborn Spaign should fail to pay to said Humphreys and Geren the above mentioned sum of two hundred and sixty two dollars one and a half cents on or before the first day of August next with lawfull interest there due from the date of these presents therefore this indenture witnesseth that the said Clayborn Spaign for and in consideration of the premises and the further consideration of one dollar to him in hand paid by the said John M. Dick before the sealing and delivering of these presents the receipt whereof he the said Clayborn doth hereby acknowledge hath granted bargained and sold and by these presents doth grant bargain and sell unto the said John M. Dick his executors administrators and assigns one Negro boy slave by the name of Jacob aged eight years one negro girl slave four years old by the name of Lively one wagon and four head of horses three feather beds and four hed of cattle and each and every of them unto the said John M. Dick his executors administrators and assigns for ever in trust and confidence never the less and for the use intended trust use intends and purposes here in after mentioned that is to say that if the aforesaid debt of two hundred and sixty two dollars one and a half cents after the same shall be deemed due as aforesaid at the time aforesaid shall not be paid off by the said Clayborn Spaign and fully and completely discharged then and in that case to shall and may be lawfully for the John M. Dick after advertising the Time and place and Terms of sale for ten days at court house door in the county of Guilford and and town of Greensboro to proceed to sell the aforesaid Negro slaves horses beds and cattle to the highest bidder for ready money and out of the proceeds thereof in the first place to satisfy all reasonable cost and charges attending the same and drawing recording and registering this deed and their bills of sale for the said Negroes slaves and in the judgment place to pay and to satisfy the said Humphreys and Geren the aforesaid sum of two hundred and sixty two dollars one and a half cents together with the lawfull interest thereon forded the debts of these presents until paid and in the third place pay over the residue if any their be to the said Clayborn Spain his legal representatives or any other person legally authorized to recuse the same but in case said debt shall be punctually and fully paid off to the said Humphreys and Geren then this indenture and every claim thereof to be void and of no effect. In testimony whereof the said Clayborn Spain hath hereunto set his hand and affixed his seal the day and date above written.
