This Indenture made this first day of September in the year of our Lord one thousand Eight hundred twenty between Clayborn Spaign of the County of Guilford and State of North Carolina of the first part John M. Dick of the County and State afore of the second part and Henry Humphreys and Abraham Gerin of the County and State of the Third part witnesseth whereas the Said Claborn Spain on the 24th day of August 1820 executed of a bond for the sum of seventy five dollars due one day after date payable to the Said Henry Humphrey and Abraham Gerin who are merchants and Copartners in trade likewise one bond for the sum of five dollars fifty seven and a half cents due on the first day of September 1820 making in the whole seventy nine dollars fifty seven and 1/2 cents and whereas the Said Claborn Shain being honestly disposed and desirous to indemnify and save hereby the Said Humphreys and Gerin the above in case in course he the Said Claborn Spain should fail to pay to the Said Humphreys and Gerin the above mentioned sum of seventy nine dollars fifty seven and 1/2 cents on or before the first day of October next with lawful interest thereon from the date of these presents therefore this indenture witnesseth the Said Clabourn Spaign for and in consideration of the premises and the further consideration of one dollar to him in hand paid the S. John M Dick before the sealing and delivering of those presents the receipt whereof is hereby acknowledged by the Said Claborn Spain hath granted bargained and sold and by these presents doth hereby grant bargain and sell unto the Said John M. Dick his executors administrators and assigns one Negro boy slave by the name of Jacob aged Eight years one Negro girl slave by the name of Lively aged four years old to have and hold the aforesaid slaves and each of them unto the said John M. Dick his executors administrators and assigns for ever in trust and confidence never the less for the uses intents and purposes herein after mentioned that is to say that if the aforesaid debt of seventy nine dollars fifty seven and a half cents after the same shall become due as afar at the time aforesaid shall not be paid off by the Said Claborn Spaign and fully and completely discharged then and in the case and shall and may be lawful for the S. M. Dick after advertising the time and place and terms of sell for ten days at this court house door in county of Guilford and Town of Greensboro to prove to sell the aforesaid Negro slaves to the highest bidder for ready money sucts of the proceeds thereof the fewer places to satisfy all reasonable costs and charges offending the same and drawing recording and registering this deed and bills of sales for the said Negro Slaves and in the second place to pay and to satisfy the Said Humphreys and Gerin the aforesaid sum of $79-57 1/2 cents together with the lawful interest thereon from the date of their those presents until paid and in the third place to pay over the residue of any then be to the Said Clabourn Spaign his legal representatives or any other person legally authorized to reserve the same but in case the said debt should punctully and fully paid off to the said Humphreys and Gerin then this indenture and every clause thereof to be void and of no effect in testimony whereof the Said Claybourn Spaign hath hereunto set his hand and affixed his seal the day and year above written.
