This Indenture made this 18th day of November in the year of our Lord one thousand, Eight hundred and Eighteen between Hinnetta Weatherly of the County of Guilford and State of N. Carolina of the one part and Edward Weatherly of the County and state aforesaid of the other part witnesseth whereas Edward Weatherly late of the county and state aforesaid Departed this life some tie in the year A.D. 1810 having first made a will and published his last will and testament in Writing and among other Divisions and Bequeaths in the Said Will Contained he the said Edward made and bequest in the words following (To wet) I give unto my daughter Mary Weatherly one negro boy name Abraham at her mother's decease the aforesaid Hinnetta Weatherly by virtue of the above trusted bequest took into her possession the Said Negroe boy Abraham by and with the consent of the Executors appointed in the aforesaid Will afterwards while the negro boy Abraham was in the possession of the said Hinnetta as of the said Hinnetta Weatherly and the Said Mary Weatherly agreed to exchange and did exchange the before mentioned negro boy Abraham with Theopholas Marshall for a negro boy named Henry and it was expressly agreed by and between the Said Hinnetta and the Said Mary before and at the time of the before mentioned exchange that the Said Hinnetta and Said Mary should have and hold the same property in the negro boy Henry that they Respectively had and held in the negro by Abraham but by some mistake or oversight the bill of sale from Theophalus Marshall the negro boy Henry was executed to Hinnetta Weatherly above for the purpose therefore of carrying into execution the aforesaid agreement between the said Hinnetta Weatherly and the said Heinetta Mary Weatherly who has since Intermarried With Aaron Bishop. Bishop the said Hinnetta Weatherly for and in consideration of the aforesaid agreement by and between her the Said Hinnetta and the Said Mary Bishop and for the further consideration of the sum of Ten Cents to her in hand paid before the sealing and delivering of these presents by the aforesaid Edward Weatherly hath this day granted Bargained sold and conveyed and by the presents doth grant bargain sell and convey in the aforesaid Edward Weatherly the Said negro boy Henry to to have and to hold to the said Edward Weatherly his executors and administrators forever in trust never the less for the Said Hinnetta Weatherly and that he the said Edward Weatherly his executors and administrators shall permit the Said Hinnetta Weatherly to have the sole use control and management of the Said negro boy Henry and all the profits arising from the labour and services of the said negro boy Henry (so that the Said Hinnetta Weatherly shall not remove the said negro boy Henry out of the county of Guilford) for and during the term of her natural life and after the decease Hinnetta Weatherly the Said Edward Weatherly his executors administrators shall immediately convey the aforesaid negro boy Henry to Mary Bishop his executors or administrators in absolute estate. In witness whereof I have hereunto set my hand and affixed my seal the day and date above written signed sealed and delivered.
