This indenture made this 4th day of June in the year of our Lord one Thousand Eight hundred and Twenty one between Sarah Dillon widow and Relick of Nathan Dillon late of Guilford County and State of North Carolina deceased of the one part and Peter Dillon and James Clemmons all of the County of Guilford and State aforesaid of the other part whereas the aforesaid Nathan Dillon in and by his last will bequeathed to the said Sarah Dillon all of his estate to hold the same during her life for her use or to distribute or give the same to any of the children as she might think proper and after her death for the same to be sold at publick sale and an equal division then to be made among the children except as to the two negroes slaves named Rhoda and Thoma which he left to her to be set free or to hold them in bondage and except also as to two tracts of lands one of which he devised after the death of the said Sarah to his son Peter Dillon and the other after her death to his grandson James C. Dillon and whereas the said Sarah is desirous of advancing her children in life and for the purpose of releasing her lifes estate in all the said property except so much thereof as is necessary for her comfortable support now this indenture witnesseth that the said Sarah Dillon for and in consideration of the premises and the sum of five dollars to her paid at or before the sealing and delivering of these presents the right whereof is hereby acknowledged hath given granted bargained and sold and by these presents doth give grant bargain and sell to the aforesaid Peter Dillon and James Clemmons all the lands and Real estate devised to hereby the said Nathan Dillon as aforesaid to have and to hold the said Lands and Real Estate to the said Peter Dillon and James Clemmons their heirs and assigns for and during the natural life of the said Sarah Dillon to the use and behoof of the several presents respectively to whom the said lands, real and personal estate are devised in remainder after the death of the said Sarah by the said Nathan Dillon as aforesaid and particularly to hold the tract of land devised as aforesaid to the said Peter Dillon and to hold the tract of land devised as aforesaid to the said James C. Clemmons (sic) to the use and behoof of Benton C. Clemmons and Henry Payn during the natural life of the aforesaid Sarah Dillon and for the consideration aforesaid the said Sarah Dillon hath bargained and sold and by these presents doth bargain and sell to the aforesaid Peter Dillon and James Clemmons all the personal estate including the two negroes slaves Rhoda and Thom bequeathed to her for life as aforesaid except the house hold and kitchen furniture one slag waggon and Harness to have and to hold the said personal property including the negro slaves aforesaid and subject to the exceptions aforesaid to the said Peter Dillon and James C. Clemmons their executors administrators or assigns upon the trust and to the use interest and purpose following that is to say that they shall hold fifty dollars to them in hand to keep out on lawfull interest and the interest to be paid over to the use and benefit behoof of Benton C. Clemmons and Henry Payn also the aforesaid Two negroes slaves Rhoda and Thom to be hered out and here to be paid over to the use and behoof of Benton C. Clemmons and Henry Payn or such other persons as the said Sarah shall at any time hereafter by writing shall appoint under her hand and seal appoint and the rest and residue of the personal property including the tract of land whereon she now resides excepting as aforesaid they shall hold to the use of all the children of the said Sarah equally for the purpose of distributing the same in equal persons among the said children or of sealing the same at publick sale and dividing the money arising there from among the said children equally and at the death of the said Sarah the said negro slaves are to be sold * the money arising from their sale together with the aforesaid $50 dollars to be equally divided among the said Children and the said Peter Dillon and James Clemmons may provide at any time after the first day of November next to distribute the said property or sell the same for the purpose of distributing the money in the manner aforesaid.
