Abstract

David Barrow asks the court to foreclose on the mortgage made by Robert and Augustus Alston in 1837. Barrow states that the Alstons borrowed $20,000 from him with the agreement to repay the amount in dollars or its equal worth in cotton; as security they put up, among other things, twenty-three slaves "and all their future issue and increase." Augustus Alston has since died, passing his share of the debt through the ownership of mortgaged slaves to Decimus A. Galliard. Barrow accuses Galliard, Alston's widow, Mary Hellen, and Robert Alston of conspiring to defraud him of the money owed. He asks the court to force the defendants to give an account of the Alston estate and make what sales are necessary to pay off the debt.
