Bennett Dooly sues for damages incurred in the purchase of an unsound slave. Dooly purchased a slaved named Ann from George Myres, who, he claims, assured him that Ann was twenty-eight years old and healthy. After purchasing Ann for $550, Dooly discovered that she was at least fifty years old and "afflicted with Divers Diseases and Malladees," and was "of little value." Dooly contends that, although Myres agreed to refund the purchase price when confronted with the situation, he now refuses to pay Dooly sues for $1,000 in damages.
Result: Granted; appealed; overturned.
