Abstract

Eliphalet Slack asks for an appeal of a judgment rendered against him. By a previous suit, Jacob Myers won a judgment against him for $500. Slack believes himself "aggrieved" by the judgment and thus prays for an appeal to the state Supreme Court. The facts of the case are revealed in the related documents. In 1829, Slack hired Myers's slave named Joe, a skilled "Whip Sawyer," for a month. According to the hiring contract, Joe was permitted to return home every two weeks to visit his wife; by necessity, his trip was undertaken by boat. On one of these occasions, Joe was returning on a skiff with Deputy Sheriff Charles Ross. Requiring rest overnight, Ross stopped the skiff and stayed at a local house. However, he was unable to persuade Joe, who he claims was "in a State of intoxication," to leave the boat. The next morning, Joe could not be found; he body was recovered from the river a few days later. Myers sued Slack for Joe's value, estimated at $1,000, plus damages.

Result: Appeal granted; reversed; remanded.
