Abstract

Jonathan Weedon owed $281 to William B. Thompson and mortgaged a term slave named Eliza "and divers other articles" to Thompson in August 1822 to secure the debt, due to be repaid in 1824. Thompson argues that Weedon has never paid the debt and "the said mortgage hath become forfeited." In order to settle his claim, Thompson asks the court to enjoin Weedon from selling the mortgaged property, to foreclose the mortgage, and to order a sale of the property, which now includes Eliza's two children born since the mortgage.

Result: Granted; appealed; partially reversed.
