Abstract
In 1831, Rachel Smith executed her last will and testament freeing a slave named Mary and giving her eleven acres of land, "all my Common or everyday clothing my kitchen furniture; one cow indifferent; say all my inferior bed clothing, Poultry and my hog or hogs." She also frees a slave named Richard and bequeaths to him wages for the year of her death so that he may be "better prepared to live uprightly." Five years later, Smith's nephew Leonard Hyfel asks that the will and the codicil be set aside in favor of a later will in which he is named the sole beneficiary.
