James Swanzy inherited several slaves from the estate of James Thompson by virtue of his marriage to his wife, Sally. Swanzy sold Thirsey, one of these slaves, and her children to Leonard Crosby. The petitioners claim that Swanzy had no right to sell Thirsey and her children because these slaves belonged to Sally's estate. Asserting their remainder interest in said slaves, they ask for a 3/5 share of ownership in these slaves; if the slaves cannot be divided in this way, the petitioners ask that the slaves be sold and the proceeds distributed among them.
Result: Appealed; reversed and remanded; granted.
