Abstract

Sidney Franklin, administrator of the estate of William McWilliams, sold the slave Mary and her child to Margaret McWilliams Busby and the said Margaret executed a note for $1000 as payment, due in one year. Franklin has learned that Busby has since sold Mary and her child to Charles McLaran. The petitioner maintains that Busby's note has been due and unpaid for over two years and that, according to the law, Mary and her child can be sold to satisfy said debt. Franklin asks that Busby and McLaran be subpoenaed to answer the charges, that they be enjoined from removing the disputed slave outside the court's jurisdiction, and that the mortgage be foreclosed.
