Catherine C. Edwards and her minor son, Charles William Edwards, seek their distributive share of the estate of Catherine's late husband, Edward Edwards. The property in dispute originated from an 1814 trust estate set up for the family of Edward Edwards by his "intimate friend," James Fisher. Fisher executed the deed of trust while Edward was married to his first wife, Mary, the mother of Edward's first five children. Daniel Edwards maintains that because his father had neither married Catherine, nor had children with her, when the 1814 deed of trust was executed, that neither Catherine nor Charles is entitled to the inheritance from the trust estate. The petitioners ask that the court appoint a new trustee for the estate, that they order a partition of the same, and that Daniel give full account of the affairs of the estate.
