Abstract

John W. Eppes, trustee for the children of Eliza Huson, joins Huson's four sons and their next friend, James M. Eppes, in seeking control of trust slaves, payment of their hire, and the appointment of a new trustee. In 1831, Eliza Huson's father, William Eppes, placed four slaves in trust for his daughter's use during her life and for her children's use after her death. Her husband, John D. Huson, had "the possession of the said slaves." In 1843 John D. Huson "hired out the ... boy Esquire to Laban Rodes for twelve months" and used the other slaves to raise cotton with Pettis W. Chick. Nancy Huson died in February 1843, so John W. Eppes told Rodes, Huson, and Chick to account to him, as trustee, for the hire of the slaves. So far, none of the defendants has complied, and the plaintiffs worry that "there are no means whereby your Orators can recover the hire of the said slaves since the death" of their mother. They request the return of the slaves and the payment of any hire due. In addition, they ask the court to replace John W. Eppes, as trustee, who is moving out of the state, with "some other fit person to take charge of said trust property."
