Abstract

Some of the heirs of Reuben and David Harrisson claim parts of David's estate. In his 1835 will, Reuben bequeathed to five of his eight living children and the heirs of his two deceased sons one-seventh shares of "the remainder of my estate that I have not already given off." He specified, however, that his son David "keep and remain in quiet possession of all my negroes, horses and mules except those given until he has paid the last Dollar for the land he purchased." David's 1836 will left most of his property (including sixty-eight slaves) to his brother John and asked John to emancipate Penny and Margaret and their children. David lived until August 1840, but he never updated his will to include a slave man named Toney or "twenty five or thirty" children born before his death. The petitioners, as David's heirs, assert their interest in these omitted slaves. They also claim "their portion of the value" of the ones listed for emancipation, because "no property in them passed to John Harrisson, nor had the Testator power to set the said Slaves free." In addition, the petitioners claim an interest in a woman named Jenny and her children, alleged to be part of Reuben's estate. The petitioners charge that John Harrisson owed money to David and took estate property not willed to him. They request a full account of David Harrisson's estate from John Harrisson and the other heirs, as well as a proper partition of David's estate and any remaining part of Reuben's estate.
