Margaret Gaston Wakefield and her current husband seek a division of her late husband's estate. Joseph Gaston died in 1847 possessed of lands and slaves and leaving his widow and three daughters as heirs. Margaret took full possession of the estate until she remarried, at which time her inheritance was reduced to a widow's dower of one third of the estate. The estate must now be divided among the widow and the daughters, but the petitioners inform the court that such a division "cannot be done without injury to some or other of the Parties." Therefore, they pray that the court order a sale of the property and that the proceeds be distributed among the heirs.
