Abstract

John H. Pearson, administrator of the estate of the late John M. E. Sharp, charges that P. Morgan Huson refuses to surrender assets that lawfully belong to the Sharp estate. John M. E. Sharp "engaged in his life time in the business of negro trading and had various and extensive transactions in buying and selling slaves in this as well as in several other Southern States." The defendant was Sharp's attorney-in-fact and agent, and as such he held notes, bonds, securities and deeds in the name of and for John M. E. Sharp. Sharp, who died intestate in Montgomery while on a slave trading venture, was deeply in debt; in fact, Pearson believes and Huson confirms that Sharp initiated this last trip hoping to earn enough money to pay off his creditors. The petitioner charges that Sharp's estate is "insolvent and in a very confused and entangled condition" and that he cannot complete the administration of the estate until the defendant delivers all of Sharp's personal accounts, bonds and notes. John H. Pearson asks the court to order the defendant to deliver Sharp's financial papers and to prove his accounts. He further asks the court to issue an injunction to prevent Huson from collecting on any accounts until this case has been settled.
