James Myrick hired Etheldred Drake as an overseer on a plantation several miles "distant from" his own residence. In August 1831, Drake fled from the plantation, "leaving every thing in a most exposed condition at that horrid crisis when the insurrection produced such an unfortunate state of feelings." Myrick suffered substantial losses "in the exposure of every thing on the plantation to the wanton waste of the negroes," and the plantation's brandy operation was especially compromised. Now Drake has obtained a judgment of $90 for his wages. Myrick seeks an injunction to halt further proceedings in its collection.
Result: Injunction granted; dissolved.
