Abstract

William Ransom Davis, former sheriff of Camden District, and four creditors of William Dinkins seek an injunction against Dinkins and William Wright. The petitioners allege that the "largely indebted" Dinkins fraudulently sold to William Wright eleven slaves, who were previously mortgaged to another party. They characterize the sale as "a covinous contrivance intended to delay hinder and defraud the just creditors" and assert that the slaves were only in Wright's possession "for a short space of time" before they were returned to Dinkins. Dinkins then enjoyed their labor and services, hiring out several of them with the admonition: "be careful to keep them out of the way of the sheriff." Eventually Sheriff Davis confiscated two of the slaves and sold them at public auction to Zachariah Cantey for £133. Wright later recovered a judgment against Davis in the amount of £150 and subsequently obtained possession of the two slaves "by stealth." Wright had earlier conveyed a family of three of said slaves to Dinkins's son Asa. The petitioners now ask the court to invalidate the sale, to help them recover the slaves, and to order Dinkins to satisfy their "lawful debts and demands."
