In 1809, James and David Garland placed a slave named Squire in trust, with Philip Smith as the trustee, for the care and support of Wiatt Smith's children. Shortly after the trust was established, Wiatt Smith moved to Kentucky, taking Squire with him. Smith remained in Kentucky for four years, but eventually returned to Virginia. Philip Smith, the trustee, claims that he was ignorant of the laws requiring that slaves transported out of the state must be registered prior to their departure. This omission, he claims, will prevent the slave from returning to Virginia "for the use & support of the Infant Children aforesaid, whereby they must sustain great injury and inconvenience." Philip Smith asks for an exemption from the law.
