Austin Peay was set free by the last will and testament of his late owner, James Ross who died in 1825. Peay asks the legislature to authorize him to remain in Virginia with his wife Fanny Woodford who has been "well provided for" by the will of the same deceased slave owner, James Ross. Peay suggests that neither he nor Fanny would become a charge on the county. He notes that a number of "respectable Citizens" endorse his petition. The text of the petition does not indicate whether or not Fanny Woodford, the recipient of Ross's liberality, had been Ross's slave.
