The children and heirs of the late Thomas Howlett Sr. ask the court for assistance in dividing fifteen slaves, who were "not specifically devised by his said Will and Codicil." They cite the specific bequests contained within the will, by which the said Howlett devised over 200 slaves and other personal property to his ten children. They inform the court, however, that fifteen slaves still remain and that the executor "has in his hands assetts sufficient ... to discharge all of the present outstanding indebtedness against said estate." The petitioners "are advised that said slaves can be and ought to be divided among the children of said Thomas Howlett Senior deceased according to the provisions of his Will," which directs that "all of the ... residue of his estate of every kind and description which may remain after the payment of his debts be equally divided among his children." They therefore pray that the court will direct commissioners to distribute the slaves equitably and appoint guardians to represent the minor heirs.
