Abstract

The heirs to the estate of the late Thomas Howlett Sr. seek to sell fifteen slaves from the estate and a division of the proceeds arising from said sale. They "represent that all of the property whereof said Thomas Howlett Sr deceased died seized and possessed has been distributed by virtue of a decree of this court according to the provisions of his will," except for the said fifteen slaves, "which are not specifically devised by said Will & which now remain in the hands of the said William Howlett and Macon Trabue as executors of said Thomas Howlett Sr decd." They further note "that said slave Sue is old infirm & valueless & will have to be sold to the lowest bidder & that the remainder of said slaves are not susceptable of a division in kind among those legally entitled to them." The petitioners therefore pray that the slaves "not specifically devised by his will may be decreed to be sold and the proceeds arising from said sale may be divided among those legally entitled to receive the same according to the provisions of the last will and testament of said Thomas Howlett Senior decd."
