In 1772, Henry Knight stipulated in his will that upon his death his "negro Wench Phillis may be sold at public Sale" and the proceeds from the sale remaining "after my just Debts, funeral Expenses, and Legacies are paid, may be equally divided between my four youngest children." As one of the said legatees, Henry Knight reports that his father's executor "did sell the said Slave Phillis and other property ... but has fail'd to render an account thereof." The petitioner seeks "the one fourth part of whatever may be found due" him from the estate of his late father.
Result: Abated due to death of defendant.
