Abstract

Jonathan Wood represents that his old and feeble father, the late Henry Wood Sr., bequeathed to him in his will "one negro boy named Jacob and one slave girl named Matilda," and that "at the making of said will and at the death of the testator" the said slave Jacob was worth between $1300 and $1600. The petitioner contends, however, that James O. Wood, "by fraud and management, induced the said Henry Wood Sr. the testator to sell him the boy Jacob ... for the promise of about $800." Charging that "James O Wood procured said contract or arrangement by fraudulent misrepresentations," Jonathan Wood prays "that said Negro Jacob be decreed to your orator to whom he properly belongs" and "that an injunction be awarded to restrain the said James O Wood from trading or otherwise disposing of said negro."

Result: Dismissed.
