The legatees of the late Charles Carroll of Carrollton ask the court to order a distribution of slaves from his estate. The testator's will provided that one third of the "Slaves which at the time of the said deceased's death should be on and belong to Doughoragen Manor" be given to Charles Carroll, one third divided among Charles C. Harper, Robert G. Harper Jr., and Emily Harper, and the remaining third given to Emily MacTavish. The petitioners assert that Mrs. MacTavish has no right to the thirty-six-year-old slave named William Joice, a blacksmith appraised at $600. Since the slaves cannot be divided equally among the "parties interested," the petitioners ask that the court authorize the executrix of the will to sell the slaves in question at their appraised value by private sale to John MacTavish. They wish that William Joice be sold at private sale to Charles Carroll.
