Abstract

Josiah Boggs seeks to settle a dispute with Mathew Thomason, his partner in a venture to buy slaves in Tennessee and sell them in Alabama. When Thomason had financial difficulties, Boggs agreed to issue Thomason two advances on the sale of the slaves and Thomason agreed to execute a bond to cover his share of any losses incurred. Boggs charges that Thomason accepted his bills of advancement but left before the bond covering any losses was executed. Boggs further states that the negroes he had purchased were sold in Alabama, Mississippi, and Louisiana and that those "sales were not advantageous as anticipated" causing him a considerable loss. Thomason, who is now in Tennessee, recently initiated a successful suit against Boggs for payment of the bills of advancement. Boggs seeks an injunction preventing Thomason and others from implementing the court's decision. He also requests recovery of the bills.
