Abstract

In 1843, Maria A. Borden's brother, Edwin Browningg, died intestate, leaving her as an heir. In 1845, Maria's husband Arnold Borden, a resident of North Carolina, made arrangements with the administrator of his brother-in-law's estate to use Maria's share to pay off a debt to a mercantile firm. Within months, however, her husband died. The widow explains that her husband, although he owned a large estate in land and slaves in Greene County, Alabama, died "greatly embarrassed." She is "infirmed & believes that the said sum of money should have been paid to her." She sues the administrator of her husband's estate.

Result: Granted.
