Abstract

Moses McLemore, administrator of the estate of the late Joseph T. Armstrong, seeks to sell for partition among the heirs' two slaves, Hampton and Lucy, who were jointly owned by Joseph T. and William T. Armstrong. The slaves, however, were sold under an execution to pay a debt owed by William T. Armstrong, and the buyer, Henry Lucas, now claims full title and refuses to give them up. McLemore sues William T. Armstrong and Lucas to gain possession of the slaves and sell them to pay creditors of his client's estate.

Result: Dismissed.
