Abstract

Claimed as a slave by Louisa Huggins, twenty-one-year-old Sarah, "a free born person of Colour," asserts that she has never been a slave, averring that her mother "was also a free born woman." Sarah states that about 1840 her mother, through an "agent," turned her over to Huggins, with the understanding that she would remain there only until she was old enough to take care of herself and earn a living. Having now reached said age, Sarah charges that Huggins claims her as a slave and has made plans to sell her. She therefore prays “proceedings under the statute that she may assert her freedom.” In her answer to the suit, Huggins asserts that Sarah has been nothing but trouble, and her immoral conduct has resulted in sickness for herself and her child. "Without knowing whether the said Sarah is entitled to freedom or not, but willing to admit that she is," Huggins "hereby abandons and disclaims ... all and any right or intention [to] hold the said Sarah as the slave or bondwoman of this defendant."
