Abstract

Margaret Fischer, wife of John Fischer, asks to regain the management of her property. A widow and owner of a sizeable estate in land, city lots, and slaves, Margaret married Fischer, an immigrant, in 1852. Margaret contends that John Fischer negotiated loans, using her land as collateral. Eventually, with her assent, he sold eight of her slaves, including Clarke, Josephine, Lizzy, and Nancy and her four children, to repay the loans. But instead of using it for that purpose, he applied the proceeds to his own use and benefit. When he fled to New Orleans, and thence to "parts unknown," perhaps Europe or California, Fischer had used more than three thousand dollars of Margaret's money. Margaret asks that John no longer have any control over and act as trustee of her property, including "rents issues and profits thereof," and that the court grant her other relief.
