Abstract
Robert Smiley died intestate in 1841. He was survived by six children. Following the death of his widow and two of the children, his three surviving sons divided up the estate, "without the forms of Law," among them. As for his daughter Sarah Jane, she took a portion of her inheritance, body servants Hannah and Viney, when she moved from the plantation where she lived with two of her brothers to the house of her husband, John R. Siler. Sarah Jane has now died, and her husband, administrator of her estate, seeks to obtain the remainder of her inheritance. Jane's brothers, however, refuse to give up any property. Siler sues and demands a "large sum of money & estate."
Result: Granted; appealed; affirmed.
