Abstract

In a previous case, the four petitioners, minor heirs of the estate of their late grandfather, William Braly, explained that their father, David J. J. W. Fulton, as administrator of said estate, allotted four slaves to their brother, John G. Fulton, in an effort to stimulate said John to "work and do something for himself." The minor heirs asserted, however, that their brother has "contracted the most intemperate habits" and might well waste the slave property, i.e., Adeline, about forty; Setilia, about fifteen; Jack, about fourteen; and Lucy, about two. They therefore sought an injunction to prevent Fulton "from further waste and destruction" of the property. The petitioners now report that the court granted their prayer and issued an injunction. Its issuance, however, occurred two days before their bill of complaint was actually filed and, in the interim, they assert that their brother transferred his interest in the slaves to Francis Duncan for two thousand dollars. The four minors, by their next friend, charge fraud, and ask for relief.
