Abstract

In 1858, Columbus A. Rose purchased eighteen slaves for $26,136, for which he signed three promissory notes: one for $8184 (due 1 January 1862); another for $8712 (payable 1 January 1863); and a third for $9240 (payable 1 January 1864). As collateral, Rose mortgaged 860 acres of land and the same eighteen slaves, along with seven additional slaves to which he already had title, to Henry M. Tompkins, trustee for Harriet Maria Pearson. With the first two notes in default, Tompkins asks that “said mortgage deed may be foreclosed by decree of your Honors Court & a sufficiency of said property sold to pay the two notes now past due.”
