Abstract

Benjamin Waters seeks an injunction to prevent the removal of the slave Clarissa from the District of Columbia. In 1813, Waters sold nine-year-old Clarissa for $135 to Pendleton Heronimus under the condition that he would not remove her from the District of Columbia or Maryland. Waters states that he "took a less price than he could otherwise have obtained upon an unconditional sale & less than was actually offered him by said Heronimus who was anxious to obtain the negro free of said condition." Heronimus has now sold Clarissa to a man named Phillips, who Waters "understands & beleives is a negro trader & purchaser of negroes for the supply of the southern market." Waters prays that the court will issue an injunction to prevent Phillips from removing Clarissa beyond the jurisdiction of the court.
