Abstract

The heirs of Alexander McIntire, deceased, state that McIntire owned three slaves, Susan West, Mary Rebecca West, and Clement Alexander West, at the time of his death in 1860. They assert that Mary McIntire, the widow and administratrix of said Alexander, refused to register the slaves as part of the estate; instead, she claimed them as her own. On 16 April 1862, Congress passed an act abolishing slavery in the District of Columbia. Owners were required to file a schedule of slaves with the court, which issued certificates of freedom. The petitioners argue that they filed a schedule of the slaves in accordance with the law. Mary McIntire also filed a schedule for emancipation and was awarded $1007.40 "as the amount to be paid by the Government of the United States for the value of said persons of African descent." The petitioners assert that they are entitled, as distributees of the estate of Alexander McIntire, to a share of the proceeds. They seek an injunction preventing Mary McIntire from receiving the award.
