Abstract

Isaac E. Holmes, as executor of the last will and testament of Elizabeth Holmes, represents that the said Elizabeth loaned Arthur Holmes $6300 in 1827 and that, "in order to secure the payment of said principal sum of money together with lawful interest for the same," he executed a deed of mortgage for eighteen slaves. The petitioner states that the debt still remains due, "no part thereof having been paid or satisfied." Holmes therefore prays that in default of payment "the said Arthur Holmes and all persons claiming or to claim by, through or under him, may be foreclosed of and from all Equity of redemption and claim, of, in and to the said mortgaged negroes; and that said mortgaged negroes may by the order and decree of this honourable Court be sold."
