Abstract

Abner J. Rogers seeks an injunction against the Southern Life Insurance and Trust Company and court settlement of a dispute over the ownership of eight slaves. Rogers explains that he purchased the slaves from William Hall "which said negroes were then mortgaged to the Southern Life Insurance and Trust Company." He further relates that the slaves were in the possession of John Choice Hall, William's brother, at the time of purchase and that said John would not release the slaves without authorization from the trust company. The plaintiff states that when he applied to the trust company for release of the slaves, they required him to agree to certain terms in order to claim the property. Now, Rogers says, the trust company has obtained a writ of attachment and "seized upon the said Eight negroes in the quiet possession of your Orator." Rogers further charges that the slaves are not subject to the debts of William Hall because they are "in the Careful custody possession & charge of your Orator."
