Augustus Roberts, a resident of Georgia, requests that a subpoena be issued to Irby Roberts, administrator of the estate of Jesse Roberts. Augustus Roberts seeks possession of, and claims ownership of, a slave included in the inventory of the estate of Jesse Roberts. Augustus states that, when his father purchased the slave woman Unity, he refused to purchase her son Tom; therefore, the plaintiff purchased the boy, allowing him to remain with his mother in the possession of the deceased, "on account of its tender age." He charges that the defendant knows that Tom is not a part of the estate of the deceased and asks that the slave be returned to him.
