Abstract

Smith Simpkins, trustee of the late Emmala A. Bellamy, asks the court to convey to him a one-fifth portion of her late husband William's interest in the estate of John Bellamy, William's father. At William's death, Emmala Bellamy elected to receive a child's part of the estate of her late husband, which included slaves and property and accordingly one-fifth of the estate "was allotted and set apart to her as her absolute property." Subsequently, the estate of William Bellamy received a distribution from the estate of John Bellamy, consisting of both land and slaves, in which Emmala was entitled to a child's share. Simpkins therefore prays that it be decreed that “one fifth part of the personal property derived to the estate of William Bellamy from the Estate of his father John Bellamy be allotted and set apart as the portion of said Emmala therein and delivered to your orator to be received and controlled by him under the provisions of said deed of Trust.”
