Thomas J. Perkins, agent, seeks to foreclose on a mortgage made by John P. K. Savage and Martha B. Savage, in which they mortgaged slaves as security for the payment of debts. The plaintiff states that the defendants had executed "an instrument in writing" acknowledging their indebtedness to J. Wayles Baker for having provided "Board Maintenance and Education" for Martha while she was a minor. Baker signed these notes over to Perkins who claims that the $4000 for which the notes were executed has not been paid.
