Carter sold Ben for $500, promising Offutt that the slave was \"sound, healthy, & entirely clear of any sickness, disease or complaint whatsoever.\"  Offutt claims, however, that Ben was \"unhealthy, unsound & afflicted with a certain chronic disease called the dropsy, or some other fatal & incurable complaint,\" a fact that Carter hid from him with the intent of defrauding him.  Ben is near death and useless to the plaintiff.
