Abstract

James C. Cook appeals to the court on behalf of his ward, William H. Mitchell, the six-year-old-son of the late William Mitchell. By his last will and testament, the late Mitchell bequeathed one-third of his estate to his wife and divided the remainder between his two children, William Henry and Mary Cox Mitchell. In addition, a slave named Starling, a blacksmith, was bequeathed to young William Henry. Henry Carlton, the executor, took possession of the estate. Mary Cox Mitchell has since died, and the widow, Ann Clarke Mitchell, has married James Cook. William Henry Mitchell has thus become entitled to two-thirds of his father's estate. Cook claims that Thomas Greenwood, Carlton's successor as executor of the estate, has refused to render a proper accounting of all financial activity. Greenwood insists that the estate has debts, a contention disputed by the petitioner. He asks that Greenwood answer his allegations in detail and that the court compel him to deliver up the estate.
