Abstract

In 1817, Samuel Beaty died intestate leaving behind a sizeable estate consisting of "Land, Negroes, Stock Cattle, horses, household stuff, plantation utensils, debts due him & divers other articles." In January 1818, James and Thomas Beaty received letters of administration from the ordinary court and subsequently took the late Samuel's estate into their possession. Starting in June 1818 and until their death a couple of years later, the two men sold a fairly large portion of the estate property, including a slave named John, and kept the proceeds for themselves. After James's death, John Guyton and Elenor Beaty were appointed administrators of his estate. They also took possession of that part of the late Samuel Beaty's estate that James had kept for himself. The same scenario developed after Thomas's death; his widow, Nancy, and her new husband, Darling Jones, took possession of his estate as well as the property from Samuel Beaty's estate in his possession. Shortly after the death of James and Thomas Beaty, John Thomas, the petitioner, was appointed administrator of the estate of Samuel Beaty. He now asks the court to subpoena John Guyton, Elenor Beaty, and Nancy and Darling Jones, and to compel them to turn the estate of Samuel Beaty over to his custody so that he can distribute it among the appropriate heirs.
