Abstract

When Paul Bevill Jr. died intestate in 1817, his widow Eliza Bevill, now married to William Lunday, was appointed administrator of the estate, which included slaves. Eliza did not assume the "burthen" of administration, but left it to her co-administrator, Paul Bevill Sr. According to Eliza, Paul Bevill Sr. took possession of his late son's property, assumed management of the estate, and collected rents and profits from it. She also claims that Paul Bevill Sr. has since refused to divide any of the property among the estate's heirs, who, besides herself as widow, include her son, three-year-old Paul, and her late husband's sons from a previous marriage, Stephen and John Bevill. Eliza contends that Paul Bevill Sr. is acting in concert with Stephen and John Bevill to defraud her and her young son by claiming the estate to be small and not sufficient to discharge outstanding debts. On other occasions, she charges, Paul Bevill pretends he never received the rents or hires of any of the estate's property. The petitioners ask the court to compel Paul Bevill Sr. to provide a complete inventory of the estate and provide an equitable division of the estate.
