Abstract
James Gibson purchased a slave named Pino for $500 from Abraham Shiver in 1821. Shiver warranted the slave as "sound and well and free from any disease whatever." Gibson, however, found that the slave was not well, but suffered from dropsy and "did linger and die." Gibson incurred medical expenses. He alleges fraud on the seller's part and sues for $1,000 in damages.
Result: Denied; appealed; upheld.
