Mary's grandfather, Phillip Mallory, loaned a slave named Rose to Mary's mother, Elizabeth Wagnon, for her lifetime, to be distributed to Elizabeth's two daughters after her death. Nathaniel Howell, the husband of one of Elizabeth Wagnon's daughters, became the guardian for Daniel Wagnon, Elizabeth's husband, who became insane. Howell then controlled the property of the estate that included nineteen slaves who were comprised of Rose and her increase. Boren contends that Howell has not distributed the estate properly, and that he is entitled to a fair settlement.
