Abstract

Cecilia Porter, the widow and the executrix of her late husband Benjamin Porter's will, states that his will stipulated that if "it could with propriety be done that the hands might remain together & be worked on the plantation where they then were untill they finish the Crop that might be in the ground at the time of his Death & make two other Crops." It also directed that his son, Thomas C. Porter, not sell any of the property "without the consent of the Executors." Cecilia Porter reports that she made the two successive crops according to the will and planted a third crop, but because of the "unfavorableness of the Seasons and other causes she has failed to extricate the Estate of its embarrassments" and the estate's debts stand at around $4,000 to $5,000. Porter further states that Richard Randolph, guardian to her son, is pressing for a division of the estate, although he refuses to give bond for the faithful execution of his duties as guardian. Wanting to discharge the debts before distributing the estate, the petitioner asks the court to have Randolph cooperate in settling the estate's debts and its later distribution. She also asks for an injunction restraining further action on Randolph's part until the issue is settled.
