Abstract

William Sowell alleges that he has sustained damages from Edward Williams in the sum of $400. Sowell paid Williams $300 for “a certain negro man named Sam," who was guaranteed to be "free from any encumbrances whatsoever." Sowell reports, however, that the sheriff took Sam on the grounds that the slave was "subject and liable to certain executions against Stephen Butler (the former owner of the said negro Sam)." Sowell asserts that, by virtue of said execution, Sam "became of no use or value to your petitioner." He therefore sues for $400 in damages.

Result: Nonsuit.
