- Court: Superior
- Salutation: To the Honorable Thomas W. Cobb Judge of the Superior Courts of the Oakmulgee Circuit in said State holding jurisdiction in Equity
Abstract
Sarah Elizabeth Harvey, a minor heir to the estate of her father, Leroy Harvey, sues by her next friend, John Harvey. Her late father left a large estate that included nine slaves. As administrator of the estate, Samuel Cook hired out the slaves and rented out the land. The petitioner states that Cook contended that Harvey's estate was in debt, whereupon he sold six slaves. Noting that Cook himself purchased the said slaves, Harvey asserts that the entire sale "was fraudulent and illegal." Now that Samuel Cook has died, Sarah E. Harvey asks the court to cancel the sale of slaves and to compel the executors of Cook's estate to settle her father's estate in accordance with his intentions.
