Abstract

The petitioners are heirs of James B. Maxwell, who died in 1805. He left a large real and personal estate that included a number of slaves. The heirs contend that the estate was mismanaged by John Pray, an executor, now also deceased. They also claim that Pray sold some of the estate's slaves for less than their "intrinsic value," diminishing the value of the estate. Since Pray's death, the petitioners have frequently requested that current executors, John J. Maxwell and George M. Waters, provide an accounting of the estate, but they have been unsuccessful. Moreover, they have not received the distributions to which they feel entitled. They ask the court to order the Maxwell executors to answer outstanding questions and work out a fair settlement and distribution of the estate. They also request that the slave sales be declared "null and void."
